Constructed.site is an online construction marketplace and connection platform designed to help customers find construction professionals and help constructors, builders, contractors and other construction-related professionals connect with potential customers.

These Terms and Conditions govern your access to and use of the Constructed.site website.

By accessing or using Constructed.site, you acknowledge that you have read, understood and agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use the website.

1. ABOUT CONSTRUCTED.SITE

Constructed.site is a platform that facilitates connections between people seeking construction-related services and construction professionals.

The platform may allow customers to:

  • Explore construction professionals;
  • View constructor profiles;
  • View photographs and information about construction professionals;
  • Submit construction-related quote requests;
  • Read reviews and other publicly available information.

The platform may allow construction professionals to:

  • Submit their information to join Constructed.site;
  • Have a professional profile created on the platform;
  • Provide information about their business and services;
  • Upload photographs;
  • Receive potential customer opportunities through Constructed.site.

Constructed.site is not itself automatically the construction service provider.

Unless expressly stated otherwise, Constructed.site does not perform construction, building, engineering, architectural or contracting services on behalf of customers.

2. DEFINITIONS

For purposes of these Terms:

"Constructed.site", "we", "us" or "our" means the operator of the Constructed.site platform.

"Customer" means a person, business or organisation seeking construction-related services.

"Constructor" means a builder, contractor, construction company, construction professional or other service provider listed on or using Constructed.site.

"User" means any person who accesses or uses Constructed.site, including customers and constructors.

"Platform" means the Constructed.site website and related services.

"Quote Request" means information submitted by a customer requesting assistance in finding a suitable construction professional.

3. WHO MAY USE CONSTRUCTED.SITE

Constructed.site is intended for individuals, businesses and organisations seeking or providing construction-related services.

By using the platform, you confirm that:

  • The information you provide is accurate to the best of your knowledge;
  • You will not deliberately misrepresent yourself or your business;
  • You will use the platform lawfully;
  • You will not use the platform for fraudulent, abusive or harmful purposes.

4. CONSTRUCTOR REGISTRATION

Constructed.site currently does not provide constructors with an automatic self-service account creation system.

A person wishing to join as a constructor submits their information through the relevant form.

Information may include:

  • Full name;
  • Business name;
  • Business description;
  • Business address;
  • Business email address;
  • Photographs or images relating to their business, services or previous work;
  • Other professional information requested by Constructed.site.

Constructed.site may use this information to create and maintain a constructor profile.

Submitting information does not automatically guarantee that a profile will be published.

Constructed.site reserves the right to review, approve, reject, modify or remove profiles where reasonably necessary.

5. ACCURACY OF CONSTRUCTOR INFORMATION

Constructors are responsible for ensuring that information submitted to Constructed.site is accurate, current and not misleading.

Constructors must not:

  • Pretend to be another person or business;
  • Submit fraudulent qualifications;
  • Claim experience they do not possess;
  • Upload photographs belonging to someone else without permission;
  • Provide deliberately misleading business information.

Constructed.site may request additional information or documentation were reasonably necessary.

6. CONSTRUCTOR VERIFICATION

Where Constructed.site describes a constructor as verified, this should not automatically be interpreted as a guarantee of the constructor's workmanship, future performance, financial position or suitability for a particular project.

The scope of any verification performed by Constructed.site may vary.

Customers should conduct their own appropriate due diligence before entering into a construction agreement.

7. CUSTOMER QUOTE REQUESTS

Customers may submit quote requests through Constructed.site.

The information provided may be reviewed by Constructed.site to identify potentially suitable construction professionals.

Constructed.site may then contact relevant constructors regarding the customer's request.

The current process is generally:

Customer → Constructed.site → Relevant constructor

Customers do not currently have a direct messaging system on the platform.

Submitting a quote request does not guarantee that:

  • A constructor will respond;
  • A quotation will be provided;
  • A customer will be contacted;
  • A particular constructor will accept the project;
  • Construction work will ultimately take place.

8. CONSTRUCTION AGREEMENTS ARE BETWEEN THE PARTIES

If a customer decides to hire a constructor, any resulting agreement is between the customer and the relevant constructor unless Constructed.site expressly becomes a party to that agreement.

Such agreements may cover matters including:

  • Scope of work;
  • Price;
  • Materials;
  • Payment;
  • Completion dates;
  • Warranties;
  • Guarantees;
  • Variations;
  • Cancellation;
  • Dispute resolution.

Users should consider obtaining an appropriate written contract before construction work begins.

9. CONSTRUCTED.SITE DOES NOT GUARANTEE CONSTRUCTION RESULTS

Constructed.site does not guarantee:

  • The quality of work performed by a constructor;
  • That a constructor will be available;
  • That a constructor will accept a project;
  • That a customer will receive a quotation;
  • That a project will be completed on time;
  • That a project will remain within its original budget;
  • That a particular constructor will be suitable for a particular project;
  • That a customer or constructor will obtain a particular number of leads or enquiries.

Constructed.site's role is primarily to facilitate discovery and connections.

10. CUSTOMER DUE DILIGENCE

Customers are responsible for conducting appropriate checks before hiring a construction professional.

Depending on the project and jurisdiction, customers may wish to consider:

  • Qualifications;
  • Licences;
  • Registrations;
  • Insurance;
  • Experience;
  • References;
  • Previous projects;
  • Reviews;
  • Written quotations;
  • Contracts;
  • Building approvals and permits.

The requirements may differ between countries and jurisdictions.

11. CONSTRUCTOR RESPONSIBILITIES

Constructors are responsible for complying with all laws and professional requirements applicable to the services they provide.

This may include requirements relating to:

  • Building regulations;
  • Health and safety;
  • Professional licensing;
  • Permits;
  • Tax;
  • Employment;
  • Insurance;
  • Consumer protection;
  • Environmental requirements.

Constructed.site does not take responsibility for ensuring that an individual constructor complies with every law applicable to that constructor's business.

12. REVIEWS AND RATINGS

Where reviews or ratings are available, users must provide honest feedback based on genuine experiences.

Users must not:

  • Create fake reviews;
  • Submit reviews on behalf of another person without authorisation;
  • Manipulate ratings;
  • Submit multiple misleading reviews;
  • Threaten another person to obtain a favourable review;
  • Publish knowingly false or unlawful content.

Constructed.site may remove, edit, restrict or decline to publish content that violates these Terms or applicable law.

13. PHOTOGRAPHS AND USER CONTENT

Constructors may submit photographs and other content for their profiles.

By submitting content, you confirm that you have the necessary rights or permission to submit and use that material.

You must not submit material that:

  • Infringes copyright;
  • Infringes another person's privacy;
  • Is fraudulent;
  • Is unlawful;
  • Contains malicious software;
  • Deliberately misrepresents your work or business.

You retain ownership of content you submit, subject to the rights necessary for Constructed.site to operate and promote the platform.

By submitting content, you grant Constructed.site a non-exclusive, worldwide, royalty-free licence to reproduce, display and use that content for purposes reasonably connected with operating, promoting and improving Constructed.site.

14. PROHIBITED USE

You must not use Constructed.site to:

  • Commit fraud;
  • Scam or deceive another person;
  • Impersonate another person or business;
  • Upload malicious software;
  • Attempt to gain unauthorised access to the platform;
  • Interfere with website security;
  • Harass or threaten users;

Any construction costs or price ranges published on Constructed.site are general estimates and are not quotations.

  • Information supplied inaccurately by users.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation would be unlawful.

24. INDEMNITY

To the extent permitted by applicable law, users agree to take responsibility for claims, losses, damages or expenses arising from:

  • Their unlawful use of Constructed.site;
  • Their violation of these Terms;
  • Their fraudulent or misleading conduct;
  • Their infringement of another person's rights.

This provision does not apply to the extent that the relevant loss was caused by Constructed.site's own unlawful conduct or where applicable law does not permit such an indemnity.

25. GOVERNING LAW

These Terms and the use of Constructed.site shall generally be governed by and interpreted in accordance with the laws of the Republic of South Africa, subject to any mandatory laws or consumer-protection rights that apply to a user in their own jurisdiction and cannot lawfully be excluded.

This means that South African law is intended to provide the primary legal framework governing the operation and use of Constructed.site, while recognising that international users may have mandatory rights under the laws applicable to them.

26. DISPUTE RESOLUTION

If a dispute arises between a user and Constructed.site concerning the use of the platform, the parties should first attempt to resolve the matter through good-faith communication.

Where appropriate, the parties may consider mediation or another lawful alternative dispute-resolution process before commencing court proceedings.

Nothing in these Terms prevents a consumer from exercising a right or remedy that cannot lawfully be excluded.

If court proceedings become necessary, they should be brought before a court having lawful jurisdiction over the dispute.

27. NO AGENCY OR PARTNERSHIP

Use of Constructed.site does not create an employment relationship, partnership, joint venture, agency relationship or franchise between Constructed.site and any constructor.

Constructors listed on Constructed.site are independent professionals unless expressly stated otherwise.

A constructor's presence on Constructed.site does not mean that the constructor is an employee or representative of Constructed.site.

28. CHANGES TO THE PLATFORM

Constructed.site may introduce, modify, suspend or discontinue features of the platform from time to time.

As the platform develops, certain features may become available or unavailable.

These Terms may therefore be updated to reflect changes to Constructed.site's services.

29. CHANGES TO THESE TERMS

Constructed.site may update these Terms from time to time.

The latest version will be published on this page together with the applicable Last Updated date.

Where appropriate, significant changes may be communicated through the website or other reasonable means.

Continued use of Constructed.site following an update may constitute acceptance of the revised Terms to the extent permitted by applicable law.

30. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it lawful and enforceable where possible.

The remaining provisions shall continue to apply.

31. ENTIRE AGREEMENT

These Terms, together with the Constructed.site Privacy Policy and Disclaimer, constitute the principal terms governing your use of the platform, unless additional terms are expressly provided for a particular service.
